1. Acceptance of Terms
Welcome to GoAU Play. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and GoAU Play Pty Ltd ("GoAU Play", "we", "us", or "our"), concerning your access to and use of the goauplaylotto.com website as well as any other media form, channel, or mobile website related, linked, or otherwise connected thereto (collectively, the "Platform").
By registering an account, accessing, or using the Platform, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Platform and must discontinue use immediately.
2. Eligibility and Account Creation
To use the services provided by GoAU Play, you must meet strict eligibility criteria designed to comply with Australian legal standards:
- Age Restriction: You must be at least 18 years of age to register an account, participate in any draws, or claim any winnings. We employ rigorous age verification checks upon registration.
- Geo-Location: You must be a resident of Australia or accessing the platform from within a jurisdiction where participation in online lottery platforms is not prohibited by law. It is your responsibility to ensure compliance with your local laws.
- Account Accuracy: You agree to provide true, accurate, current, and complete information during the registration process and to update such information to keep it accurate. Failure to provide accurate information may result in the forfeiture of winnings and account termination.
- Account Security: You are responsible for keeping your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine it is inappropriate or objectionable.
3. Purchasing and Ticket Validity
When you use our Platform to purchase entry into a lottery draw or syndicate, the following purchasing rules apply:
- Agent Capacity: GoAU Play acts as a secure purchasing agent on your behalf. We purchase official tickets for the requested draws. We are not a lottery operator ourselves.
- Cut-Off Times: Purchases must be completed prior to the posted cut-off time for each specific draw. Cut-off times are strictly enforced to ensure enough time for official ticket processing. Orders placed after the cut-off time will be entered into the subsequent relevant draw.
- Finality of Purchase: Once a purchase is confirmed and payment is processed, it is final and non-refundable. You cannot change your selected numbers or cancel your entry once the order status is 'Confirmed'.
- Proof of Entry: Your digital confirmation within the 'My Account' section serves as proof of your entry. GoAU Play retains physical or secure digital copies of the official tickets on your behalf.
4. Payouts and Claim Limits
We pride ourselves on guaranteed, transparent payouts for all valid winning entries:
- Secondary Prizes: Winnings below the threshold of $10,000 AUD are typically credited directly to your secure GoAU Play wallet within 1-3 business days following official draw result confirmation. You may withdraw these funds to your verified bank account at any time.
- Major Jackpots: For winnings exceeding $10,000 AUD, additional verification processes are legally required. Our concierge team will contact you directly. Major payouts may require direct transfer from the official lottery operator, which can take up to 14-30 business days to clear.
- Taxation: While Australian lottery winnings are generally tax-free, participating in international draws (e.g., US Powerball) subjects your winnings to the tax laws of the originating country. Any quoted jackpot amounts for international draws are usually pre-tax estimates. GoAU Play is not responsible for paying your taxes; any mandatory withholding taxes applied by the source country will be deducted before payout.
- Syndicate Payouts: Winnings from syndicate play are divided strictly according to the number of shares you purchased relative to the total shares in the syndicate pool.
5. Account Termination and Suspension
We reserve the right, in our sole discretion, to suspend or terminate your account and block your access to the Platform without prior notice or liability, for any reason, including but not limited to:
- Violation of these Terms of Service.
- Suspicion of fraudulent, abusive, or illegal activity (which may be reported to appropriate law enforcement authorities).
- Failure to pass Know Your Customer (KYC) or Anti-Money Laundering (AML) checks.
- Attempting to manipulate, hack, or disrupt the operation of the Platform.
If your account is terminated due to fraudulent activity, any pending entries will be voided, and funds may be frozen pending legal investigation.
6. Dispute Resolution and Governing Law
These Terms and your use of the Platform are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.
In the event of a dispute, controversy, or claim arising out of or relating to these Terms, or the breach thereof, you agree to first attempt to resolve the dispute informally by contacting our escalation team at resolutions@goauplaylotto.com. If the dispute cannot be resolved informally within 30 days, it shall be settled by binding arbitration administered by the Australian Centre for International Commercial Arbitration (ACICA) in Sydney, NSW. You agree to waive your right to participate in any class action lawsuit against GoAU Play.
